Demarcus Davis and Roger Rodriguez Convicted of Murder
Co-Defendants Found Guilty of Murder, Felony Murder, and Armed Robbery

Following a four day trial, a Madison County Circuit Court 1 jury found Demarcus Davis and Roger Rodriguez guilty of Murder, a felony, Felony Murder, a felony, and Armed Robbery, a Level 3 felony, in a joint trial for the June 27, 2023, shooting death of Timothy Kates. Following the jury's verdict, both Davis and Rodriguez admitted to being habitual offenders. Judge Angela Warner Sims set sentencing for February 10, 2025, at 10:00 am where they each face a maximum sentence of 85 years. The State's case was presented by Deputy Prosecutor Jennifer Haley and Chief Deputy Prosecutor Andrew Hanna. The case was investigated by Detective Travis Thompson of the Anderson Police Department.
On June 27, 2023, officers of the Anderson Police Department were dispatched to an address on W 13th St. reference the homeowner locating a body, later identified as Timothy Kates, inside the residence. An autopsy determined Kates died as the result of six gunshot wounds. Subsequent investigation revealed Demarcus Davis, Roger Rodriguez, and Timothy Kates met at the residence for some type of transaction. While Rodriguez and Kates were inside the residence, Davis briefly exited to his car and within several seconds of returning inside, multiple shots were fired. A handgun was located next to Kates' body and both Davis and Rodriguez claimed self-defense at trial. After deliberating for over three hours, the jury returned a guilty verdict on all counts.
